island, new york. today the candidates stayed out of the spotlight really. hunkered down as the campaigns put it doing debate prep. both sides well aware of how vital this one is. spokesman for the obama campaign says he knows mitt romney had a better night than he in the first debate. his team says look for the president to get more energized this time around. that's the word they are using now. polls show governor romney got a boost from first debate performance, no question. his campaign is obviously looking to keep that trend going. one of his senior advisors says tomorrow the romney team expects the president to, quote: launch one attack after another in an attempt to distract from his record and make up for his weak performance in denver. however, the format of tomorrow's debate could make that pretty difficult. you see, it's a town hall with both men answering questions that are submitted by the audience. so they may have fewer opportunities to actually take direct jabs at one another. but, you can bet governor romney will be looking for any chance to hammer home about the president and the attack

on our consulate in libya and how the administration handled it we'll have more on that with ed henry who is tonight in williamsburg, virginia where the president has been practicing for tomorrow. he will have all the details. first, let's get to carl cammeron in new york tonight. tell us how both sides have been getting ready. >> well, for mr. romney he has spent a tremendous amount of time on a mock stage set up just as it will be tomorrow night at hofstra university. his aides have been working on body language, encouraging him to lean in and answering questions. body language look like a retreat don't back away. encouraging him to use the opportunity to show he can connect to voters. that's one of the criticisms to mr. romney. both of these candidates are very familiar with the town hall format, it's just that they haven't been doing it with their opponents sitting on stage waiting for the follow-up. mr. obama will be taking questions from the audience. he too will try to elm if a pa theisman and try to turn it around and use it on the president. the speed in which he does the pivot could determine whether he wins on style points let alone substance.

>> shepard: interesting. both camps preeminent strike on candy crowley. >> she says she will allow a facilitation process. questions she will will have chosen herself in advance and that if the candidates in her words were to start talking about apples when the questions were about oranges, she will do a little bit of correction. now, some on both sides, the campaigns have suggested to the debate commission that there that they are a little concerned that her role was supposed to be reduced if not virtually nonexistent. no, i'm going to ask those questions, they have expressed their concerns. we will find out whether or not tomorrow night candy crowley gets a big starring role or whether she sits back and let's the voters do without. tomorrow is both substance and style, domestic and foreign. it's a big one. the joe biden and paul ryan debate will easily be eclipsed by this, and it really sets the stage, it comes exactly three weeks from election day. >> shepard: three weeks to go. carl cammeron, thank you. see you in hempstead. tomorrow's showdown will likely mark the first time it

the tragedy in libya comes up during a presidential debate. the first head-to-head matchup focused on the economy and other issues. during the vice presidential candidates the vice president said: we did not know diplomats in libya had asked for more security ahead of the attack that killed four americans. the white house later said the vice president was speaking only for himself and president obama. a senior advisor for the romney campaign now says obama administration's story keeps shifting as he puts it and americans need honest answers. team fox coverage continues now. ed henry williamsburg, virginia. the white house still answering the vice president's comments from last week, ed's. >> that's right, shep. on friday they tried to clarify by saying look, all the vice president meant was when he said "we didn't know about more security requests in libya. "he meant the president and vice president. not the rest of the administration. that put some of the president's top advisors on the sunday talk shows on defense yesterday. and it led some of mitt romney's advisors to suggest

that maybe what the vice president really was doing was throwing the secretary of state under the bus. take a listen. >> there is no doubt that some of these matters went into the security department at the state security agency at the state department. but it didn't come to the white house. that's what the vice president was responding to. >> we, generally means your administration. when you are talking as the president or the vice president of the united states including your state department. what we have been see something an effort by president obama and vice president biden to say no it was really secretary clinton. >> now, libya could come up tomorrow night because as carl said it's different from the first debate in denver because tomorrow night it will be half domestic, half international policy. so this could go up, but since it's a town hall format, you know, governor romney has to be careful if he starts charging a coverup for the president in front of these swing voters that could back fire and look too negative and same for the president. if he gets too aggressive in trying to make up for lost

time after that first debate that he lost, it could back fire on him as well, shep. >> shepard: a lot of strategy involved here. over the last few days, ed, has the president had anything to say about the situation in libya? >> you know, he hasn't said very much while he has been here in williamsburg. he has been hunkered down. he made a brief visit to a local campaign headquarters here delivering some pizza to some of his volunteers to sort of fire up the troops if you will. he has done a handful of -- he hasn't commented extensively, the vice president did get that question last week. the president could get it tomorrow night. interesting that we -- fox has learned tonight that senator lindsey graham the republic from south carolina is firing off a letter to the president with some pointed questions. if you look at these he says quote: mr. president were you informed of some of these attacks on our consulate. two attacks on the u.s. consulate in benghazi. if not, why not? do you consider these serious events? if you were informed, what action was taken to protect the consulate. those were the two previous times the consulate were

targeted back in april and june. lindsey graham trying to attack to the heart of the matter here. the third and final presidential debate next thursday night in florida. that's foreign policy not domestic at all. some of those questions may be coming up, shep. >> shepard: ed henry live in williamsburg, virginia. registered voters are expected to ask most of the voters. selected them from sample of people there in nassau county on long island where hofstra is located. gallup reported it asked each person a series of questions and selected those reporters who signaled that they were still uncommitted either side. but 100 people are scheduled to be in the audience. you can see the debate live right here on fox news channel tomorrow night begins just before 9:00 eastern, 8:00 central. we are planning to be there for "studio b" and fox report. again that's from hempstead, new york, hofstra, university we will see you then. deadly outbreak contaminated shots for back pain. the feds say the company that

made those injections may have also made other drugs that could be tainted. officials with the food and drug administration are warning patients who have received any injections from that massachusetts-based pharmacy. that firm sends medicine to clinics all over the country. according to the f.d.a., three patients were sickened after receiving injections from drugs not linked at all to the initial outbreak. one is a different type of steroid called -- triamcinolone and a heart medicine which the f.d.a. has not named. both came from the same company in massachusetts. the feds say they still can't confirm exactly what those three patients took to make them sick. but they are blaming the pharmacy for these steroid shots which officials say were, indeed, contaminated with fungus. they now link the drug to 214 cases of fungal meningitis. its killed at least 15 people. today pennsylvania became the 15th state to confirm that it has a case.

elizabeth prann is live with the news from atlanta disease control and prevention. what do we know about these other poo potentially at least contaminated injections. >> we're learning from from the f.d.a. one additional produced by this center fungal meningitis. two heart patients have contracted this same. the f.d.a. is not confirming they have the noncontagious form of meningitis. those patients received intillable cardiac solution which is used to slow the heart during surgery. health officials say there may be other sources of the fungal infection. the f.d.a. is now asking doctors to speak with patients about any injectable medications manufactured by the boston based pharmacy which includes eye medications used during surgeries, shep? >> shepard: we reported elizabeth that their investigations into that pharmacy. any news from the investigations? >> well, we're hearing from the attorneys that the company is cooperating with both state

once he made a safe landing he was certainly all smiles. here's the jump. it took nine minutes for baumgardner to reach the ground yesterday. by the time it was all over he had shattered not one but three records. first person to break the sound barrier without the use of a jet or space craft. highest manned balloon free fall from the highest altitude. more than 128,000 feet above the ground. that's roughly three times the altitude your standard 747 flies. and look at this video from one of the 30-some cameras recording the stunt. this is attached to his chest.

at this point during the plunge he started spinning and they tell us it was a violent spin but he got himself under control after about 30 seconds. the dare devil said for a few moments he was afraid he would lose consciousness. >> when i was standing there on top of the world, you become so humble, you cannot think about breaking records anymore. you do not think about gaining statistical data. you want to come back alive. do you not want to die in front of your parents your girlfriend and all the people watching this. >> shepard: youtube says there were more than 8 million simultaneous views of this free fall. that's another record. this event could provide a glimpse into the future of space exploration. fearless phoenix made the same jump that the satellite endeavour made its arrival at its home in los angeles, california. the skydiver almost had to

>> 13-year-old girl who survived a brutal attack by the taliban is now in the hospital in great britain for medical care and her own protection. militant gunmen stormed that teenage girl's school bus last week and shot heir in the head and neck in retaliation for her support of education for girls. she had been blogging about life in northwestern pakistan where women are still essentially second class citizens. as a result, the taliban claimed she was guilty of

pushing western thinking. but the attack is reportedly horrified many pakistanis and they have gathered by the thousands to show support for the badly wounded girl. despite that country's long history of religious extremism. "the fox report's" jonathan hunt is with us tonight. what are doctors saying about how she is doing. >> british doctors looking after her are saying there are privacy laws that they need to be aware of so they won't tell us much about precise conditions. we do know, of course, that doctors in pakistan before she even left there to travel to the u.k. removed a bullet from her head. she has suffered a lot of damage in the head and neck area. she has a long, long road to recovery. but the doctors in the u.k. say the very fact that they brought her there ask a good sign. listen. >> very clearly says the doctor, some of whom were people here from children's hospital believe that she has a chance of making a good recovery because clearly it would be inappropriate on every level not least for her

from pakistani officials, a strong condemnation of that attempted murder. who know what is will actually happen. >> shepard: thank you. the captain of the cruise ship that capsized off the coast of italy today apologized for the deadly wreck at a hearing whether the case should go to trial. cruised too close to shore struck some rocks and tipped on its side. 4200 passengers at the time. 32 of them died. the captain, however, was one of the first people off the ship we now believe. he claimed he tripped and miraculously fell into a life boat. prosecutors have not yet charged him but he could face counts of manslaughter and abandoning ship. there are also a number of lawsuits pending from passengers and families of the victims. the hearing continues tomorrow. more than a decade after the attacks of 9/11. the confessed master mastermind and several other suspects are back in court today as prosecutors fight to keep state secrets under wraps. we're live at guantanamo bay

>> shepard: more good news on the economy. a jump in spending helped market higher today. retail sales went up more than 1% last month. a similar gain back in august. that could mean consumers are more confident in the economy. of course it also means that people are paying more for some things. for instance, higher prices at the pump helped gas station sales up more than 2%. investors liked today's news. dow up 25. s&p up 12. one major bank now has to explain how it lost personal data belonging to more than a quarter million customers up and down the east coast. it's t.d. bank and reports the information was on a set of backup tapes that somehow went missing back in march. social security numbers and bank information were among that data. the spokesman for t.d. bank said the company has begun notifying some 260,000 customers who are affected by. this another spokeswoman says, quote: we have no evidence that the data on these tapes

is being used for any inappropriate purpose. we continue to i have gently monitor our customer accounts. i'm shepard smith. this is the fox report. it's the bottom of the hour. time for the top of the news. a showdown over secrets now unfolding at guantanamo bay. today's five men taking parts in the attacks of 9/11 taking part in preliminary hearing. suspects include the admitted mastermind of 9/11 khalid mohammed. his lawyers and suspects are fighting prosecution over the rules of planned military tribunal. prosecutors say they want strict regulations that would prevent classified information from going out during the tribunal. defense lawyers say the proposed rules are too tough and would actually hurt their case. the stakes here are live and death because if the five suspects are convicted they could face execution. several issues have repeatedly delayed this week's hearing. everything from religious observances to an internet

outage to a tropical storm and now they are finally underway. and more than 1,000 miles to the north of families of 9/11 victims are seeing it all. they are monitoring the hearings over closed circuit television at military facilities here in new york and new jersey, massachusetts and maryland. they are watching the member accused of helping to kill their loved ones and more than a decade after the attacks they are still waiting for justice. catherine herridge with the news. she is live at guantanamo bay. catherine? >> shep, this is the first time that we have heard anything of substance from khalid sheikh mohammed since 2009. i was just 30 feet away when he said, quote: i don't think there is any justice in this court. one key issue was decided today and that's whether the five 9/11 suspects can waive their right to be in court which simply means they could skip this week's hearing all together. the prosecution said it's their choice. the defense says it's more evidence that appearances, not justice are all the government cares about in this case. >> what you saw today was

exactly that. it was the prosecution fighting very hard to make sure that the defendants were required to come to court against their own will so that the process can seem to be fair. >> aside from the right to a trial and the right to counsel, and the right to a jury, impartial fact finder, the right to presence is the most fundamental. >> if there was a moment in court today it, belonged to the parents of andrea habberman, she was killed on the 92nd floor. she was on first business trip to new york stock exchange -- new york city on 9/11. she wanted to be in court and walk along the defense table and look the five 9/11 suspects in the eye to see if they even had a soul. four years ago president obama said he would close the camps here at guantanamo bay. four years later 166 detainees remain. what we expect is that the ultimate trial will take place a year from now and some of

these families who lost adult children have told me that they believe they will probably be dead before this trial is finished and all of the appeals are exhausted, shep. >> shepard: catherine herridge at guantanamo bay tonight, thank you. turkey reports it's intercepted another plane bound for syria. turkish officials ordered armenian plane flying to syrian city of aleppo to land. they searched its cargo and then cleared it when they confirmed it was carrying humanitarian aid. last week turkey intercepted syrian plane headed from moscow to damascus. the turkish prime minister claimed it was carrying russian made military supplies. fox news has confirmed many of the weapons the gulf arab states have sent so the syrian rebels have gone to jihadists. paper first reported that repore united states is frustrated over the weapons shipments it can't ensure they go to secular fighters. important to note the united states is not sending records

to syria according to our government but instead giving intelligence to nations directly arming the opposition, nations including audi arabia and qatar. jennifer griffin is on this story life from the pentagon tonight. jennifer, officials in washington say they are surprised that these jihadists are getting these weapons? >> the state department, the cia, the administration has been warning since the beginning that they didn't know where these weapons would go. they had a very difficult time knowing from the beginning who they actually were. >> i'm just gonna say that we have been tracking this all along. we have been discussing our concerns about extremists hijacking the aspirations of the syrian people all the way through. we have urged careful vetting, all those kind of things and we will continue to do so. >> another senior u.s. officials told me, quote: it's not exactly easy to determine where all of this lethal material goes, which

explains, in part, why the united states is treading carefully. some lethal aid probably does fall into the wrong hands and in syria these days, the right hands one day can be the wrong hands the next. that's unfortunate but it is the nature of this dynamic conflict. it's interesting to note that the israelis have not requested that the u.s. be more involved in syria and certainly have not requested that the u.s.s. arm the opposition because the israelis know how quickly those arms could be acquired by groups that would then turn them against israel, shepard. >> shepard: politically speaking, the president and his challenger are both on the record on this idea of aiding the syrian rebels. >> well, the president has taken some heat for not getting more involved in syria as he did, in fact, in libya. many have wanted to know what the difference was in syria. we're starting to see what the difference is. and a candidate romney had this to say last week. >> in syria, work with our partners to identify and organize those members of the

opposition who share our values. and then ensure that they obtain the arms they need to defeat assad's tanks and helicopters and fighter jets. >> the syrian government today denied a human rights watch report that shows the remnants of cluster bombs that were dropped over several syrian cities on the road north from the capital to aleppo. these russian-made weapons explode in the air over the city killing civilians and militant alike and are banned by most nations. syria, however, never signed those human rights conventions, shepard. >> shepard: jennifer griffin reporting from the pentagon tonight. president obama today ordered all flags in the u.s. on government and military buildings to fly at half-staff in honor of the late pennsylvania senator arlen specter. the long time lawmaker died over the weekend after a battle with non-hodgkin's lymphoma. he was 82. many politicians from both sides of the aisle remember him a rare commodity in today's political client. a moderate whom his colleagues say always did his best to try

for consideration so with the election three weeks out. court to come literally at any moment. shep? >> shannon bream, thank you. privacy advocates are slamming a texas school district for tracking students with electronic chips. students at a middle school and a high school in san antonino must now wear i.d. card embedded with these chips. the school district reports it has no intention to spy on students and that the chips helped track attendance which is directly tied to state funding. but an official toe american civil liberties union calls the practice dehumanizing and adds, quote: what kind of lesson does it teach our children if the chip like cattle. spoke with the science and technology editor foxnews.com and he he explained that these chips are much different than g.p.s. >> we have g.p.s. signals that beam from tens of thousands of miles away. tiny little things called rfid chips. they beam for only a few feet.

review board that she appointed delivers its -- finishes its investigation and delivers its recommendations and there is no indication that is going to happen before the election. asked about whether the extending the guard's time in tripoli would have made a difference to the tragedy in benghazi she said there has been testimony it would not have made a difference, she went on to say she is not going to draw any conclusion until the accountability review board finishes its work and makes its recommendation. and asked also, shepard, about u.n. ambassador susan rice's comments a week after this incident at benghazi that it was something that grew out of the protest that we now know never occurred. secretary clinton contributed that to the fog of war. the confusion you get in any kind of combat situation. remember, this was an attack that went on for hours. she said there had to be a lot of sorting out and she noted that people all the time said here is what we know now sung
